ADOPT TERMS OF SERVICE

This T.O.S is required to be signed for all purchases.COPYRIGHTS
I retain the copyrights or IP to my designs after purchase.Non-licensed users are prohibited from using or republishing my designs, including derivative works created or commissioned with my designs by the licensee.OWNERSHIP POLICY
• Your purchase is a license agreement to use my designs for personal or commercial uses.• Title of ownership to the adopt will not be valid until the adopt is fully paid off. It should not be used or claimed in any way until that time.• Using the design for small-scale branding (group/account mascots, or any personalized use) or personal-owned merchandise is allowed.
Larger-scale commercialization will require approval, and depending on the predicted scale of the project may require a commercial fee.• You may redesign the adopt. However, the original design must still be present in the adopt's profile or completely separated if different enough.Please follow all other policies below concerning the use or exchange of the adopt.RESELL POLICY
• You must wait a grace period of one week (7 days) before reselling an adopt.• The resale price may be above original value if extra art is added, with the raise being proportional to the value of the art added.• You may resell below the original marketing value adopt’s original worth is noted.TRADING POLICY
•If you’re reselling an adopt you traded for, you can only sell it off on another trade offer.
You cannot resell a traded adopt for cash or currency.• You can only sell an adopt you traded for money if the adopt has new artwork that was added from your ownership time.Regular resell rules apply.THIRD-PARTY & GIFTING POLICY
GIFTING POLICY
• If you are buying an adopt as a gift, the intended recipient is required to be made aware of and sign this TOS.• If you own a gifted adopt, you are not allowed to resell it for more than 35% of the price the actual buyer paid for it unless artwork was added to the character.THIRD-PARTY POLICY
• If you are a third-party payer (i.e you are paying for a purchase on behalf of the primary intended buyer) the payer is required to sign this TOS.• If you own an adopt paid by a third-party, you are not allowed to resell it for more than 35% of the price the actual payer paid for it unless artwork was added to the character, or there is a payback deal with the third-party payer.• If a mishap or dispute with the payment occurs from a third-party payment, the primary intended buyer of the purchase will be held responsible for the loss.ARTWORK POLICY
• The initial adopt artwork given is not to be edited or drawn over in any way, shape, or form except for watermarking.• Unwatermarked versions of the adopt will NOT be available!
You are free to ask for a transparent PNG of the adopt artwork, but it will still contain my watermark.• Do not use the original artwork I made of the adopt for commercial use.• When owning, I do not condone feral NSFW artwork of my designs whether it’s commissioned or self-drawn.• Theft, copying, republishing, false ownership, etc of my adopts/designs/art will NOT be tolerated!• Do not feed my artwork into AI programs.TOYHOUSE POLICY
• The original character folder is to be kept so the creator credits and ownership logs stay consistent.• If the adopt is heavily redesigned keep the original design present in the adopt’s profile, or separate the designs completely.• If you do not have TH, I will still keep the character’s folder on my profile in the “Sold Adopts” folder.• If the person you’re reselling to does not have TH, note down the New Owner's info in the description and send the folder back to me where I will store it under "Sold Adopts".EMAIL POLICY
• Your email address is confidential and will not be shared with anybody.• Do not share my email address or forward any emails I send to other people.BLACKLIST POLICY
• Users who are on my blacklist are not allowed to purchase or obtain my designs.This includes:
• Purchasing/obtaining from me directly, including through deceit.• Having a third party purchase on your behalf, or gift it.• Purchasing/obtaining from resellers.ACCEPTANCE POLICY
• You cannot change your offer after it is accepted.
Haggling afterward will not be tolerated.• You must respond to the acceptance of your offer within less than 3 days, or else your offer will be dropped.PAYMENT POLICY
• Cash payments must be made to the right PayPal / CashApp account.• I only accept USD!
If you use another currency, you must make sure you have enough for the money to be converted to the right USD amount.• E-checks are NOT accepted.• Deviant Art Points must be received through the appropriate priced DA Shop Widget. They should NOT be gifted unless specified.• If you are looking to split your payment between USD & DA Pts, I will not take more than 30% of the total price of the purchase in Points.• Your payment must be sent within less than 3 days of confirming your purchase.• The amount received in any medium must be the amount promised in your offer.HOLD POLICY
This T.O.S is required to be signed for holds.• A down payment of at least 30% of the price is required for holds pertaining to preclaims or auctions.• High risk clients will be asked for down payment up to 50% of the price, or may be completely denied the ability to hold.
Down payments are non-refundable.• You must make your hold payment by your stated estimated payment date.
If you miss your hold date, you will be given less than 3 days to respond before your hold is dropped.• If you keep pushing back your hold, your hold will eventually be dropped.• Situational holds are negotiable, but if a more favorable offer comes in it is of my best interest to take the latter.• You cannot change your initial offer during a hold.PAYMENT PLAN POLICY
Your plan must contain the following:
• An initial 30% down payment amount on the day of negotiation.
• Your installment plan -- the periods of payment and the amount of each payment.
• An estimated date of completed full payment.• You must have at least 3 periods of payment (down payment, and two other payment periods) for your offer to be considered a payment plan.Depending on the payment period, there is an expected minimum payment amount:
• At least ~$25.00-$35.00 for weekly plans
• At least ~$45.00-$60.00 for monthly plans
This can change depending on the full amount owed and negotiaion details.I will not accept a payment plan if:
• Your total purchase is less than ~$65.00-$70.00.
• Your installments are not reasonably periodical.
• You are greylisted with the condition of being unable to do holds.• If something comes up that prevents you from paying your dues it is your duty to communicate that to me.
You are only given one push-back opportunity before your plan is dropped.• You cannot change your offer during a payment plan.Payment plans and all installments are non-refundable.ARRANGEMENT POLICY
An arrangement is an agreement to be the primary buyer of an adopt under certain circumstances when the option to hold is not approved.• An arrangement does not equal a hold. The adopt you agree to buy is still considered available and can be put on hold, put up for auction, or bought by someone else.• You cannot change your offer during an arrangement.CO-OWNERSHIP POLICY
The following policies only apply if you are purchasing a co-ownership of an adopt with me, or are planning to co-own an adoptable immediately with another person.Otherwise, you may disregard this section.
[CO-OWNERSHIP POLICY]REFUND POLICY
All purchases and payments are FINAL, and not refundable.Refunds will only be given if there are certain mishaps with the adopt, or if the funds are needed for an emergency.The adopt must be returned if you are asking for a refund. You cannot use the adopt after refunding.A refund and return must priorly be discussed and agreed to by both parties. Unwarranted disputes or chargebacks will not be tolerated.The reason to refund must be valid and timely. Miscellaneous reasons or extended turn around times will not be acceptable.Please note that I cannot guarantee that I will have the funds available to refund you.

CO-OWNERSHIP POLICY

POLICIES REGARDING CO-OWNING WITH MENormal adopt rules apply.I will maintain the original ToyHouse folder of the character, but you may create your own TH folder of the character and have it linked to the main one.YOU CAN USE THE OC FOR:
• Personal art
• Personal uses
• Commissions
• Challenges/contests
• Roleplay
• Story writing
• Appropriate shippingYOU CANNOT:
• Draw or commission NSFW artworks with the characters.
• Hitch your co-ownership with other people (freely letting a third party in the co-ownership).
• Purchase physical items with the character (plushes, shirts, etc) unless you are a mutual.RESELLING CO-OWNERSHIP
• You are allowed to sell your part of the co-ownership after a two week grace period.• You can only price your part of the co-ownership in accordance to how much material you contributed on your side.• Do not sell your part of the co-ownership without my acknowledgment or letting me know who the possible buyers are.• Please respect my concern if someone you may be selling co-ownership to is someone I, or any co-owners, do not see eye-to-eye with.POLICIES REGARDING CO-OWNING WITH OTHERS
If you are planning to co-own an adopt immediately when purchasing, the co-owner must also sign my TOS.All other regular adopt policies apply. The rules of co-ownership between you and your party is up to you.

COMMISSION TERMS OF SERVICE

This T.O.S is required to be signed for all services.COPYRIGHT
• I retain the copyrights to my artworks and designs.
Non-clients are prohibited from using or republishing my artworks and designs.PRICES
• The quote of your commission is negotiable, but the agreed upon price cannot be changed after signing.• Any major requested changes to your commission order may result in an additional fee for the added work.SERVICE REFUSAL
• I have the right to refuse or discontinue service, or drop your order for any valid reason (I.e: rudeness, delayed payment, bad reputation, blacklist).PAYMENTS
• Upon signing this T.O.S, you are obligated to pay for your commission order.• Payment must be made at 100% upfront, or by when the final sketch is given for approval.• Payment must be sent to my PayPal or CashApp in USD, or a Deviant Art Shop Widget for Points.• E-Checks are NOT accepted.ART USE & CREDIT
• The artwork may be used by the client for normal purposes as long as there is appropriate credit.• Do not remove watermarks.• Any form of theft, tracing, or editing of the artwork will not be allowed.• Do not feed my artwork into AI programs.COMMERCIALIZING
• The art should not be used commercially (I.e: Merchandise, YT videos and thumbnails, shirts, pins, stickers) or directly sold.• Printing for shirts, pins, stickers, etc will only be allowed if it is a personal item that only you will have.WILL TO WORK
• All artworks will only be standard pieces. I will not be doing: scenes/groups, over-complex characters, gore, complicated poses or angles, canon characters, NSFW.• By not giving me a due date for a commission, you agree that you are willing to wait an indefinite amount of time for your commission to be completed.• Communication must be maintained throughout the commission period. If I do not get responses for more than a week I will give a final warning before canceling the commission within the following few days.
Commissions cancelled due to client disappearance cannot be refunded.BLACKLIST
• Blacklisted users are not allowed to commission or receive artwork from me directly, indirectly, or through third parties. This includes through friends buying gifts.REFUND POLICY
Refunds will not be available once your commission order is confirmed!An order is considered confirmed once this T.O.S is signed. By then, the payment is owed and cannot be refunded or forcefully disputed.I will only refund if I am unable to complete to a commission, the commission is cancelled/dropped by me, and/or if the refund is necessary for an emergency situation.However, I can only refund you based on the amount of work completed, and I cannot guarantee that I will have the funds to refund you.
